- This website is pre-launch and informational. There’s no app to download yet.
- You can join the waitlist; we’ll email you when there’s something to install.
- This is a New Zealand business, governed by New Zealand law.
01Who we are
StopBy is operated by Tom Hartley, a sole trader based in Havelock North, New Zealand. References in these terms to StopBy, we, us, or our mean Tom Hartley, operating under the StopBy brand.
References to you or your mean the person using this website.
02What this website is
stopby.ai is a pre-launch website for the StopBy iOS app, which is currently in development. The website lets you:
- Read about what we’re building
- Join a waitlist to be notified when the app launches
- Read this document and our Privacy Policy
The website does not currently provide access to any downloadable software or paid service. Specifications, dates, and features described on this website are forward-looking statements about a product still in development, and may change before launch.
03Accepting these terms
By using this website, you agree to these terms. If you don’t agree, please don’t use the website. You must be at least 16 years old to join the waitlist.
If we update these terms (see Section 13), continued use of the website after the update means you accept the updated terms.
04Joining the waitlist
By submitting your email to our waitlist, you’re asking us to send you occasional pre-launch updates and a launch announcement. You’re not committing to buy anything, install anything, or do anything else.
You can unsubscribe at any time using the link in any email we send. Unsubscribing removes you from the list. There is no penalty for unsubscribing, ever, for any reason.
Don’t submit someone else’s email address without their permission, or a fake one. (It just makes our list noisier without helping anyone.)
05Acceptable use
Don’t use this website to:
- Submit false information, including someone else’s email address without their consent
- Attempt to disrupt the website or its hosting infrastructure
- Probe for security vulnerabilities (if you find one, please report it to security@stopby.ai)
- Scrape, copy, or republish substantial parts of our content without permission
- Do anything that’s illegal under New Zealand law or the law of the country you’re using the website from
Reasonable, fair-use quoting and linking for journalism, review, or commentary is welcome. You don’t need to ask.
06Intellectual property
The StopBy name, the StopBy logo and brand assets, the website design, and the written content on stopby.ai are the intellectual property of Tom Hartley unless otherwise indicated. You may not reproduce, distribute, or create derivative works from them without written permission.
The domain stopby.ai is owned by Tom Hartley.
If you have a question about a specific permission — for example, you’d like to write about StopBy and want to use a screenshot — email hello@stopby.ai. We’re easy to deal with.
07Third-party links
This website may link to third-party websites — for example, FocusAI (focusai.co.nz), social media profiles, or research and reference material. We’re not responsible for the content, privacy practices, or terms of those websites. Your use of them is governed by their own terms, not ours.
08No warranties
This website is provided as is and as available. We don’t warrant that it will be uninterrupted, error-free, or available at any particular time.
We don’t make any guarantees about when (or whether) the StopBy iOS app will launch, what features it will include at launch, what it will cost, or which countries’ App Stores it will be available in. The website describes our current intent, not a binding promise.
Nothing in this section excludes warranties or guarantees that can’t be excluded by New Zealand law (including the Consumer Guarantees Act 1993 where it applies to a transaction with you).
09Limitation of liability
To the maximum extent permitted by law, Tom Hartley is not liable for any indirect, consequential, special, or punitive damages arising from your use of this website — including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim relating to this website is limited to NZD $100.
Nothing in this section limits our liability for fraud, gross negligence, death or personal injury caused by negligence, or anything else that can’t be excluded under New Zealand law (including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where applicable).
10Indemnity
You agree to indemnify and hold harmless Tom Hartley from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these terms or your misuse of the website. This indemnity does not apply to anything caused by our own negligence or wrongdoing.
11Termination
We may suspend or terminate your access to the website at any time if you breach these terms or for legitimate operational reasons (for example, if your traffic is harming the service for other people). We will normally try to contact you first.

12Governing law and disputes
These terms are governed by the laws of New Zealand. Any dispute arising from these terms or your use of the website will be heard in the courts of New Zealand.
If you’re a consumer in another jurisdiction, mandatory consumer protection laws in your country may also apply. We don’t attempt to override those.
Before starting any formal legal proceedings, please email hello@stopby.ai first. Most disagreements can be sorted out in a single email exchange.
13Changes to these terms
We may update these terms from time to time. The last updated date at the top will change.
Material changes — particularly the launch of the StopBy iOS app, which will introduce a substantial new set of terms covering app use and subscriptions — will be notified to waitlist subscribers by email before they take effect.
